These Terms govern your access to and use of the market size tool on qxnt.net (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Informational Use Only (Not Advice)

The Service generates projections and outputs based on U.S. Census Bureau data, the location and radius you provide, and industry benchmark assumptions. The Service is provided for informational purposes only and does not constitute financial, investment, accounting, engineering, legal, or other professional advice. Your use of the Service does not create any advisory, fiduciary, or professional-client relationship with the developer or any affiliated party. You are solely responsible for your decisions and for validating all assumptions and outputs with qualified professional advisors.

2. No Guarantee of Results

Outputs are hypothetical and may differ materially from actual results due to numerous factors, including but not limited to costs, timing, staffing, demand, competition, regulations, macroeconomic conditions, weather, and data limitations. The developer does not guarantee accuracy, completeness, or suitability for any purpose. Census figures are survey estimates with margins of error, and figures for block groups partly inside the radius are apportioned by area.

3. Acceptable Use

You agree not to misuse the Service or attempt to interfere with its normal operation. You are responsible for complying with local laws, regulations, and standards applicable to your use of the Service and any business activities informed by it.

No AI training: you may not use the Service, its content, or any outputs (including projections, charts, or text) to train, fine-tune, or improve any machine-learning or artificial-intelligence models, and you may not permit any third party to do so.

No automated access/scraping/resale: you may not scrape, crawl, or bulk-export the Service or its outputs; attempt to reverse-engineer or extract the underlying model or source code; or resell the Service or its outputs to third parties; or attempt to circumvent usage limits or automated-traffic verification.

4. Warranty Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement.

5. Limitation of Liability

To the maximum extent permitted by law, the developer and its affiliated parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Because the Service is free, the total aggregate liability for any claim arising out of or relating to the Service will not exceed $100.

6. Indemnification

You agree to indemnify and hold harmless the developer and its affiliated parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

7. Changes and Availability

The Service may change or be discontinued at any time without notice. These Terms may be updated from time to time; continued use after an update constitutes acceptance of the updated Terms. Usage limits apply and may change.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, for any dispute arising out of or relating to the Service or these Terms. Where permitted by law, you and the developer waive any right to participate in a class action.

9. Export Controls and Sanctions

You represent that you are not located in, and will not use the Service from, any country or region subject to U.S. embargoes or comprehensive sanctions, and that you are not on a U.S. restricted-party list. You agree to comply with applicable export control and sanctions laws when accessing or using the Service.

10. Time to Bring Claims

Any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after it accrues; otherwise, the claim is permanently barred, to the maximum extent permitted by law.

11. Data Sources

This product uses the Census Bureau Data API but is not endorsed or certified by the Census Bureau.

12. Privacy

Addresses you enter are sent to the U.S. Census Bureau geocoder to find coordinates and are not stored. A rounded location (about 100 m) and radius are cached for up to 30 days to serve repeat lookups. IP addresses are stored only as one-way hashes for rate limiting and expire within 24 hours. Cloudflare Turnstile is used to block automated traffic and processes data under Cloudflare's privacy policy.
